Terms and conditions of sale and delivery
- The product
The trips, products and services sold by Ifish Travels.
Ifish Travel cannot be held responsible for the buyer’s choice of travel, product or service.
All trips are offered by Ifish Travel and organized in cooperation with subcontractors. Subcontractors are accommodation establishments, hotels, lodges, fishing guides, boat rentals, foreign tour operators, etc. Ifish Travel considers all 3rd party companies/persons who are financially involved in an offered trip as a subcontractor.
Content of the journey
Ifish travel descriptions of trips and destinations can be found on the company’s website. The itineraries are considered to be indicative and Ifish Travel reserves the right to change the composition of daily programs. There will never be a removal of included travel elements. If the trip indicates that it includes, for example, 5 full fishing days, this will not be changed.
Change of package travel
If there is a change in what is included in a package tour confirmed by the customer, and the change is considered to be of a significant nature, the customer may claim compensation or, in extreme cases, have the purchase canceled.
In the event that single day events are canceled, the customer will be entitled to compensation for these. Included here are fishing days lost due to weather conditions. If other arrangements are listed on the customer’s invoice where Ifish Travel has not been able to deliver as agreed, the customer will also be entitled to compensation.
Cancellation of events and fishing days does not entitle the customer to either cancel the purchase or claim a full refund. A canceled fishing day can be compensated up to a maximum of the purchase price of the individual fishing day.
A fishing day can only be canceled by the captain of the boat or the tour leader. As a customer, you cannot cancel a fishing day for any reason.
It is also not possible to obtain compensation on health or other grounds for not being able to participate in a fishing day or other activity. In this case, it will always be the customer’s private travel insurance that will provide any compensation.
Departure dates
In some cases, package tours may include indicative departure dates. In cases where the date of departure is clearly marked as indicative, Ifish Travel is fully entitled to change the date of departure after the buyer has concluded the purchase agreement.
- Property law
Ifish Travel retains ownership of the product until the full purchase price has been paid.
- Transfer of risk and delivery
Upon delivery, the risk of the product passes from Ifish Travel to the buyer.
All physical products are delivered ex works. warehouse, unless otherwise agreed in writing in advance with the buyer.
If Ifish Travel has title in the product, it is the responsibility of the buyer to insure the product from delivery until the agreed purchase price has been paid.
- Limitation of liability and claims for defects
The buyer loses the right to make complaints if the complaint is not made immediately after the buyer has become aware of Ifish Travel’s possible liability.
Ifish Travel cannot be held liable for any direct or indirect costs, losses and consequential damages under this product liability claim, which occur during the buyer’s possession.
Immediately upon receipt of the invoice and travel description, the buyer must examine the accompanying material to ensure that there are no errors or omissions.
If the product is faulty or defective, the buyer must immediately bring the fault or defect to the attention of Ifish Travel. Defects must be notified immediately after delivery and no later than 8 days after delivery. If this is not done, the purchaser forfeits the right to claim for defects.
Complaints about defects in the trip must be addressed to Ifish Travel or its representative on the trip immediately when the defect is found, so that the matter can be rectified as soon as possible. Defects are understood to be the non-delivery of all or part of what is stated in the buyer’s invoice and the accompanying travel description.
In the event that Ifish Travel is not satisfied with Ifish Travel’s remedy of the defect found or in the event of failure to remedy the defect, the buyer has the right to submit a written complaint to Ifish Travel with a claim for compensation. If during the trip the buyer has accepted Ifish Travel’s rectification of the defect, received compensation or otherwise accepted Ifish Travel’s solution of the defect, the buyer loses the right to raise objections later.
If the buyer fails to draw attention to errors and defects immediately after these are found, it is not possible to have the complaint processed after returning home, cf. §26 (1) of the Package Travel Act.
For any claim, Ifish Travel must have a copy of the original purchase invoice. If a copy of the purchase invoice is not provided, the complaint will be rejected.
- Terms of payment
All payments are made via the Ifish Travel website or by bank transfer. In the case of bank transfer, the terms of payment are set out in the invoice sent. In the event of non-payment by the due date, default interest shall accrue at the rates set by Ifish Travels and applicable from time to time.
When purchasing a trip, a deposit is required. The deposit is non-refundable. The amount of the deposit is shown on the buyer’s invoice. The deposit is usually 20% of the price of the trip.
The balance of the price of the trip is shown on the buyer’s invoice. The due date for payment of the balance is stated on the buyer’s invoice. Normally, the balance payment must be made no later than 90 days before departure.
- Buyer’s responsibility and cancellation
Participation in Ifish Travel’s trips, guided fishing trips and courses is at your own risk.
It is the responsibility of the purchaser to take out travel and cancellation insurance at all times. Ifish Travel cannot be held responsible for lack of travel and cancellation insurance. It is only in the event that Ifish Travel cancels a trip that the buyer is entitled to a full refund of the full amount of the package. Cancellation insurance must normally be taken out before the trip is purchased. Ifish Travel recommends that buyers of our travel packages speak to an insurance company about this.
If the buyer wishes to cancel a trip, the cancellation must be submitted in writing to Ifish Travel. There is no right of withdrawal on package travel, cf. the Consumer Contracts Act § 18 (2), no. 12. Unless otherwise stated on the buyer’s invoice, the following applies to any cancellation of a package tour. A deposit paid is non-refundable. Any balance paid is non-refundable. If the total price of the package is charged at the time of booking, this amount is non-refundable in case of cancellation.
Unless the buyer and Ifish Travel have agreed in writing to refund the deposit, the balance or the entire price of the package in the event of cancellation, no refund can be made. Ifish Travel recommends that all customers take out a private cancellation insurance policy.
If Ifish Travel has to cancel a trip, the customer will receive a full refund of the amount paid. In addition, Ifish Travel cannot be held financially responsible for any other losses the buyer may incur in connection with the canceled package tour.
Ifish Travel informs Ifish Travel of changes to the trip prior to departure, Ifish Travel must have received the buyer’s objection and or complaint regarding the changes. the change immediately after it has been brought to the purchaser’s attention. If no objections are raised by the buyer, Ifish Travel considers it as an acceptance of the notified change.
It is the responsibility of the buyer to check at all times that names are spelled correctly on all documents sent by Ifish Travel. When traveling abroad, it is recommended to spell names as they appear in the passport of the buyer/participants. Ifish Travel cannot be held responsible for any delays, fees or other consequences that the customer’s incorrect information of names may cause.
It is at all times the buyer’s own responsibility to show up on time at the meeting times indicated by Ifish Travel. This also applies to meeting places and times abroad. If the buyer does not show up at a pre-arranged place at the agreed time, Ifish Travel cannot guarantee to provide all services related to the travel package.
If the buyer fails to show up at one or more scheduled points during the package tour, it is not possible for the buyer to obtain any compensation for this. This applies regardless of the reason for non-attendance.
Ifish Travel can at no time be held liable for any breach by the buyer of the security measures provided by Ifish Travel or its affiliated partners. For example, Ifish Travel cannot be held responsible for the buyer’s failure to wear a life jacket.
It is the responsibility of the purchaser to ensure that all necessary vaccinations are carried out at all times. Ifish Travel cannot be held responsible for the lack of vaccinations and their consequences.
It is the responsibility of the purchaser to take out independent travel and cancellation insurance at all times.
The buyer is always responsible for ensuring that all necessary personal documents required to complete the package are in order. It is thus the buyer’s own responsibility to ensure that all required entry documents are valid and comply with the entry rules of the country of entry. Ifish Travel cannot be held responsible for the consequences of any errors or omissions in the buyer’s personal documents.
Ifish Travel cannot be held responsible for damage to participants’ gear/equipment.
Ifish Travel cannot be held responsible for personal injury that occurs/occurs during travel, guided fishing trips and courses.
Ifish Travel cannot be held liable for any direct or indirect loss.
- Other reservations
We reserve the right to make printing errors, price, currency and/or tax changes, as well as changes in product specifications, operating instructions and/or marketing materials.
- Force majeure
Ifish Travel’s obligations are suspended when non-fulfillment is due to circumstances beyond Ifish Travel’s control, including strikes, lockouts, import/export bans, earthquakes, other natural disturbances, war, warlike operations, neutrality violations, measures to protect against such, civil war, insurrection or civil commotion, blockade and damage caused directly or indirectly by or in connection with fire, nuclear reactions such as fission, fusion and radioactive decay, whether such damage occurs in time of war or peace.
- Jurisdiction and applicable law
Danish law will govern any disputes and any legal proceedings may, at Ifish Travel’s option, be brought before a Danish court. Ifish.dk shall, however, be entitled to demand arbitration in accordance with the general rules of Danish law.
